Millinery Loan Agreement

HAT HAVEN MILLINERY

Millinery Loan Agreement

Editorial, Campaign, Photoshoot & Creative Projects

Hat Haven Millinery may loan select hats, fascinators, and headpieces for approved editorial shoots, advertising campaigns, fashion photography, runway presentations, and other creative projects. This agreement establishes the terms for borrowing and caring for Hat Haven Millinery pieces.

By accepting a loan, the stylist or authorized representative agrees to the following terms on behalf of the production company, publication, brand, or client they represent.

1. Project & Loan Details

Project / Campaign: __________________________________

Publication / Brand / Production Company: __________________________________

Stylist / Authorized Representative: __________________________________

Loan Period: __________________________________

Scheduled Return Date: __________________________________

Intended Use: __________________________________

All loaned pieces will be documented in an accompanying inventory sheet detailing each item, its condition, and its replacement value.

2. Loan Fees & Payment Authorization

Editorial and creative loans may be offered at Hat Haven Millinery’s discretion. Commercial campaigns, advertising projects, or other uses may be subject to a loan fee, which will be disclosed and agreed upon before the items are released.

A valid credit card may be required on file before a loan is approved, particularly for high value pieces, commercial projects, or first time borrowers. Any applicable loan fees, approved repair costs, replacement costs, or other agreed upon charges will be communicated in advance whenever reasonably possible.

The borrower authorizes charges only as permitted under this agreement and any separately agreed fee terms.

3. Collection & Return

All pieces must be collected from and returned to Hat Haven Millinery at the agreed upon times, unless alternative arrangements have been approved in advance.

All items must be returned in their original hat boxes and packaging, along with any accompanying accessories, labels, or materials.

The borrower is responsible for arranging and covering return shipping, including appropriate protective packaging and tracking, unless otherwise agreed in writing. Hat Haven Millinery must be notified promptly if a shipment is delayed or a return deadline cannot be met.

4. Care & Handling

All millinery must be handled with care and returned in the same condition in which it was received, allowing for no damage or alteration.

The borrower must take appropriate precautions to prevent makeup, hair products, perspiration, adhesives, pins, dirt, or other substances from transferring onto or damaging the pieces. Protective barriers, including protective liners inside hats, must be used when appropriate.

No alterations, trimming, gluing, pinning, reshaping, or other modifications may be made without prior written approval from Hat Haven Millinery.

Pieces must not be exposed to moisture, excessive heat, crushing, or other conditions that could compromise their structure, materials, or finish.

5. Damage, Loss, Theft & Replacement

The borrower is responsible for the safe handling and security of all loaned pieces from the time they are received until they are returned to and received by Hat Haven Millinery.

Any damage, loss, or theft must be reported promptly.

  • Repairable damage: The borrower is responsible for reasonable repair costs associated with damage occurring during the loan period, beyond the condition documented at check-out.
  • Irreparable damage: If a piece cannot reasonably be repaired, the borrower is responsible for its documented replacement value.
  • Lost or stolen items: The borrower is responsible for the documented replacement value of any item that is lost or stolen while in their care.
  • Late returns: Extensions must be approved in advance. Unapproved late returns may result in additional agreed upon loan fees or documented costs resulting from the delay.

Replacement value will be recorded in the accompanying inventory before the loan is released. Because many Hat Haven Millinery pieces are handcrafted or one of a kind, replacement value may reflect the cost of creating a comparable replacement, where applicable.

6. Credit & Attribution

Hat Haven Millinery must be appropriately credited wherever credits are provided and the format permits.

For social media, please tag @TheHatHaven and identify Hat Haven Millinery in the caption where appropriate.

For editorial, print, runway, and digital projects, please include Hat Haven Millinery in the credits wherever applicable. The borrower agrees to communicate the requested credit information to the relevant production team, publication, or client.

7. Image Access & Usage Rights

Hat Haven Millinery would appreciate receiving copies of approved images featuring its millinery for portfolio, website, press, and social media use.

Hat Haven Millinery may repost or share images only after they have been publicly released by the relevant photographer, publication, brand, or production company and subject to applicable image rights, permissions, licensing terms, and embargoes.

Where required, the borrower will assist in identifying the appropriate photographer or rights holder to request permission for use. Photographer and creative team credits will be included wherever possible.

This agreement does not transfer ownership of photographs or grant Hat Haven Millinery automatic rights to use images. Any additional licensing or usage fees remain subject to agreement with the relevant rights holder.

8. Commercial Use & Exclusivity

The loan is approved solely for the project and intended use identified in this agreement. Any additional campaign, publication, advertising placement, commercial use, or subsequent project requires prior written approval from Hat Haven Millinery.

Loan approval does not automatically include exclusivity, paid advertising rights, or permission to use Hat Haven Millinery’s name or designs to imply an endorsement or partnership beyond the approved project.

Additional fees may apply to extended use, exclusive arrangements, or expanded commercial usage and must be agreed upon in writing before such use.

9. Loan Inventory & Condition Report

A written inventory will accompany the loan and record the following for each piece:

  • Item description and identifying details
  • Condition at the time of release
  • Documented replacement value
  • Accessories and packaging included
  • Condition and completeness upon return

The borrower should review the inventory upon receipt and notify Hat Haven Millinery promptly of any discrepancies or pre-existing damage.

10. Acknowledgment & Agreement

By signing below, the borrower confirms that they have read and agree to the terms of this loan agreement. The borrower accepts responsibility for the care, security, and timely return of the loaned millinery and acknowledges the financial responsibilities outlined above.
